Abstract

يناقش هذا المقال الوضع القانوني لكيان من الذكاء الاصطناعي (AIE) قادر على ابتكار شيء جديد، مثل عمل فني. وبدلا من دراسة كائن خيالي، أتقصّى موقع الإنسان، مع مقارنته بموقع كيان ذكي محتمل. وتُقارَن طبيعته، من حيث المادة والعقل، بطبيعة الإنسان، ثم يُبحث فيما إمكانية عدّه، مثل الإنسان، شخصا قانونيا. وتمهّد هذه الدراسة للسؤال عمّا إذا كان يمكن لهذا الكيان أن يكون مالكا لحقوق المؤلف.

Author Biography

  • Jasper Doomen, Leiden University

    Lecturer and Researcher in Legal Philosophy at Leiden University. He previously held the same position at, among other institutions, Utrecht University. He obtained a Master's degree in Philosophy from Leiden University in 2003, a Bachelor's degree in Philosophy from the same university in 2005, a Ph.D. in Law from Utrecht University in 2005, and a second Ph.D. from Leiden University in 2014. His publications primarily focus on topics in the fields of philosophy and law.
